Action by Kenneth Duane Smith against defendants Gerald Thomas Willer and his insurance carrier, St. Paul Fire & Marine Insurance Company, to recover damages for personal injuries sustained as a result of an automobile collision. Trial was to the court and a jury. The jury returned a special verdict in which Smith was found to be 65 percent causally negligent and the defendant Willer 35 percent negligent. Questions in the verdict relating to property damage, medical expense and past wage loss were answered by the trial court. As to past and future pain, suffering and disability, the jury awarded $2,000. Plaintiff appeals from the judgment.
